Payne was one of the lead plaintiffs in a lawsuit against the city over police actions at the George Floyd riots in May and June of 2020. He participated in an illegal protest near the Trump Tower in Manhattan after an 8 pm curfew went into effect and was arrested. Payne may have been looking to score another lucrative lawsuit when he got himself arrested at a 2021 MLK day protest. He was quoted as saying, "“The killing of George Floyd was the last straw for me, and it captured many of the issues facing Black people in America."
