Smith is a radical environmentalist who participated in a tree sitting protest against Massey Energy in 2010. It rained on him so he decided to surrender to the police waiting at the base of the tree. Smith's charges are unknown but most of the protesters were arrested for trespassing. The "action" took place in West Virginia but many of the protesters were from Pennsylvania which may be Smith's home state.
